Welcome to TuneThis. These Terms and Conditions govern your access to and use of the TuneThis website and services. By accessing, registering, uploading content, or streaming music on this platform, you agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you must not use the platform.

1. Definitions

  • "Website" refers to TuneThis and all related pages, services, and features accessible through the TuneThis platform.
  • "User" refers to any visitor, registered member, listener, or uploader on the website.
  • "Artist" refers to any User who uploads music or other audio content.
  • "Content" includes music, audio files, artist names, images, artwork, text, metadata, descriptions, and any other material uploaded or displayed on the platform.
  • "Services" refer to music streaming, content hosting, promotion, storage allocation, and related features provided by TuneThis.

2. User Eligibility

  • You must be at least thirteen years old to use this platform.
  • If you are under the age of majority in your country, you confirm that you have obtained permission from a parent or legal guardian.
  • By using the platform, you represent that you are legally capable of entering into these Terms.

3. Account Registration

  • To upload, host, or promote music, you must create an account.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You agree to provide accurate and complete information during registration.
  • TuneThis reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Content Upload, Ownership, and Artist Representations

  • Users retain ownership of their uploaded Content.
  • By uploading Content, you grant TuneThis a non-exclusive, worldwide, royalty-free license to host, store, stream, publicly perform, display, promote, and make the Content available to users of the platform for the duration of its availability on TuneThis.
  • You represent and warrant that you are the sole owner of the Content or that you have obtained all necessary rights, licenses, permissions, and consents required to upload and stream the Content. This includes rights from record labels, producers, beat licensors, songwriters, featured artists, and any other rights holders.
  • You further confirm that uploading and streaming the Content on TuneThis does not violate any contract, recording agreement, distribution deal, or exclusive arrangement with any third party.
  • You acknowledge that TuneThis does not pay royalties and is not responsible for any royalty obligations, performance rights organization fees, or reporting requirements related to your Content.

5. Copyright Infringement and Takedown Policy

TuneThis complies with the Digital Millennium Copyright Act (DMCA) and respect copyright laws. If you believe that Content on the platform infringes your copyright, you may submit a valid copyright or DMCA takedown notice through our contact channels. Upon receipt of a valid notice, TuneThis may remove or disable access to the Content without prior notice to the uploader. Repeated infringement may result in account termination. TuneThis is not required to investigate ownership disputes beyond acting on valid takedown requests.

6. Artist Names, Branding, and Impersonation

  • Users must not upload Content under an artist name that infringes trademarks, misleads the public, or impersonates another artist or entity.
  • TuneThis does not verify artist identity and is not responsible for disputes involving artist names or branding.
  • TuneThis reserves the right to rename profiles, remove Content, or suspend accounts involved in impersonation or name disputes.

7. Streaming and Platform Use

  • The platform allows streaming for personal and non-commercial use only.
  • Downloading, copying, redistributing, or making derivative works from streamed Content without permission is prohibited.
  • Users acknowledge that no streaming system can fully prevent third-party recording or copying. TuneThis does not guarantee digital rights management protection and is not responsible for unauthorized recordings made by users or third parties.

8. Storage Allocation and Content Availability

  • Artists may pay for allocated storage space to host Content on the platform.
  • Uploaded Content is stored and made available for a maximum period of three months unless otherwise stated.
  • After the expiration period, Content may be permanently deleted without notice.
  • TuneThis is not a backup or archival service. Artists are responsible for maintaining their own copies of uploaded Content.
  • No refunds will be issued for deleted or expired Content.

9. Promotions and Paid Services

  • Artists may purchase promotional or visibility services.
  • Payment for promotions, storage allocation, or premium features is non-refundable unless required by law.
  • TuneThis does not guarantee streams, engagement, popularity, or commercial success from promotions.

10. Prohibited Conduct

Users must NOT:

  • Upload content Content that is illegal, infringing, defamatory, obscene, or offensive.
  • Attempt to hack, scrape, or disrupt, or interfere with the platform or its infrastructure.
  • Use automated systems, bots, or artificial methods to manipulate streams or engagement.

Violation of these rules may result in content removal, account suspension, termination, or legal action.

11. Payments and Refund Policy

  • All payments made on TuneThis are final.
  • Refunds are issued only in cases of billing errors or verified service failures at TuneThis’s discretion.
  • Chargebacks or payment disputes may result in account suspension.

12. Privacy and Data Protection

  • User data is collected and processed in accordance with our Privacy Policy.
  • TuneThis does not sell personal data to third parties.
  • Users may request account deletion, subject to legal and operational requirements.

13. Limitation of Liability

  • TuneThis provides the platform on an as-is and as-available basis.
  • We do not guarantee uninterrupted access, error-free operation, or data security.
  • TuneThis is not liable for losses arising from content disputes, account termination, data loss, hacking incidents, third-party actions, or unauthorized use of Content.
  • To the fullest extent permitted by law, TuneThis’s liability is limited to the amount paid by the user for services in the preceding three months.

14. Indemnification

  • You agree to indemnify and hold harmless TuneThis, its owners, operators, and affiliates from any claims, damages, losses, or legal expenses arising from your Content, your use of the platform, or your violation of these Terms.

15. Termination and Suspension

  • TuneThis reserves the right to suspend or terminate accounts at any time for violations of these Terms or applicable laws.
  • Users may terminate their accounts at any time.
  • Termination does not waive any outstanding obligations.

16. Changes to Terms

We may update these Terms from time to time. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
